The EU General Data Protection Regulation (GDPR) is the most important change in European privacy legislation in the last twenty years. It replaces the 1995 EU Data Protection Directive (European Directive 95/46/EC), strengthening the rights the European Economic Area (EEA) individuals have over their data, and creating a uniform data protection law across Europe.
Within the scope of our consultancy activities in European countries, our company Avertim SPRL (with registered offices at Avenue Louise 149, 1050 Brussels BCE 0892.519.071) follows the guidelines of the applicable GDPR regulations. We will ensure that our partners and collaborators also meet their GDPR obligations. It is Avertim’s utmost priority to protect the privacy of its candidates, clients, prospects, suppliers and users of its website.
This document outlines how your personal data are managed within Avertim and its potential third parties. When you use or contact us via this website for services, your personal data will be collected and can be processed in accordance with the following.
1. What kind of personal data is collected?
We collect personal data from you that will enable us to engage in particular services, supplies or employment opportunities.
For the recruitment process, we collect different types of information at the different stages of the process: personal information and contact details, as well as professional information collected from the candidate’s curriculum vitae. In doing so, we ensure that we only collect the information we need to proceed with your application. In order to get your agreement to data processing, we will request your consent at a later stage in the recruitment process.
In some instances, additional appropriate information may be requested depending on the country in which the position is vacant / available. This will be done in accordance with local laws and legal requirements, and your specific consent will always be requested prior to processing those additional personal data.
2. How are your data collected?
Avertim may collect your personal details through the following ways:
- Request for services (clients, prospects)
- Proposal for services (suppliers)
- Online application on the Avertim website (candidates)
- Application through a job advertisement (candidates)
- CV submission to an Avertim staff member (candidates)
- Recommendations provided by others on your behalf
- Internet searches (e.g. LinkedIn) performed by an Avertim staff member
3. How are your data used?
For candidates, Avertim will use personal data to:
- Assess the candidate’s suitability for employment
- Assist us in finding projects that best matches candidate’s skills and profile
- Answer to your enquiries
- Perform administrative tasks (e.g. reimburse you for interview-related expenses)
- Perform internal analysis of our applicant pool in order to better understand who applies at Avertim
- Perform any legally required reporting and respond to legal processing
- Carry out our obligations arising from any contracts entered into, between Avertim and its clients (potential clients), in relation to a candidate’s recruitment
For clients, suppliers and website users, Avertim will use personal data to:
- Execute a contract and communicate on relevant tasks inherent to the contract
- Answer to request for services and enquiries
- Use contact information to notify you about services offered by Avertim
4. Who has access to your data?
Your personal data will be stored in secured and protected locations and in secured and protected electronic databases located in EEA and supported by a hotline located in the EEA. Access to personal data will be limited to the human resources functions, finance and administrative functions and business management functions. Your personal data may also be shared via email with the Avertim staff located at our global offices (Amsterdam, Frankfurt and Paris).
5. With / to whom may your data be shared / transferred?
If you are a candidate, we may share / transfer your personal data with third parties, with your consent. Personal data may be shared / transferred with / to the following categories of individuals:
- Avertim Clients if your profile and skills are suited for one or more projects assigned by the Clients to Avertim
- Potential Avertim Clients in case your skills or profile may are suited for one or more projects assigned by the potential Clients to Avertim
Avertim may be obliged to share your details with government officials whenever legal reporting requirements are in effect, or law enforcement agencies or private litigants in response to valid law enforcement processed (warrant, subpoena, or court order). Under these circumstances, sharing of your information is a legal obligation.
Avertim will never share / transfer Personal Data to non-business related third parties, to direct marketing organizations and / or to third parties located outside of the EEA.
6. How long will your data be stored?
Avertim will retain your personal data for no longer than the period required to comply with applicable laws and regulations or to achieve the purpose for which it was collected. For example, for clients and suppliers the main retention period applied is ten years after the termination of the contract, to the extent no diverging local retention periods exist. After that period, we will delete your personal data from our systems.
Avertim does not store sensitive personal data such as race, medical information, religion, sexual orientation or criminal records. Avertim does not store personal data of minors.
7. What rights do you have regarding your data?
Even if we already hold your personal data, under GDPR you still have rights in relation to them. You may send Avertim a request in regard to any right described below.
Upon reception of your request, we will:
- Comply after verification of your identity or ask for more information about your request
- When we are legally permitted to do so, we may decline your request, however accompanied with an explanation as to why.
- Right to access
You have the right to ask us to confirm what information we hold about you at any time
- Right to rectification
You may ask us to rectify or update your information
- Right to erasure
You may request that we delete your information from our database at any time
- Right to restrict the processing
You may also request that we restrict the processing of your personal data
- Right to data portability
You have the right to transfer your data from us to another data controller
- Right to object
You have the right at any time to object to the processing of your data
- Right to withdraw consent for use of personal data
While we are using your personal information with your consent, you also have the right to withdraw your consent at any time, though this will not affect our use of your personal information prior to the withdrawal of your consent.
On top of these different rights, you have the right to lodge a complaint with the appropriate supervisory authorities of your country (Privacy Commission).
9. How to obtain more information or submit a request related to your personal data?
For any request and application of one of your rights listed in paragraph 7, please send us a request or contact our Data Privacy Officer (DPO), via the email email@example.com.
To facilitate the process please provide us with a copy of your ID card. We will use it only to process your request and delete it afterwards.
